On November 4, 2010, Hon. Bonnie Sabraw, a retired judge of Alameda County Superior Court, gave a talk in San Francisco, CA on gender bias. Sabraw graduated from San Francisco Law School in 1979, and provided an inspiration that even when someone does not graduate from a nationally known school, the person can move up to become a partner at a law firm, and a judge. The person just needs to keep in mind courtesy in behaviors, gestures, and speech.

Sabraw spoke about bias in the courts and how people can get into trouble with contempt citations at hearings when they are rude and insulting. In one example, an appeals court upheld the statement “You’re not my mother” as being contemptuous on its face, not requiring a hearing for citation.

Sabraw discussed gender bias in litigation, with an example of an attorney insulting someone at a deposition by calling the person “little girl” or “little lady”. Sabraw cited statistics and surveys of female attorneys being treated differently from male attorneys. This may be something a person should keep in mind when thinking about hiring a San Francisco bankruptcy attorney.

More than 4 million fear they`ll be made redundant

According to R3`s quarterly personal debt tracker, more than 4 million (an estimated 4,258,737) people fear they`ll be made redundant.

The insolvency trade body found that those aged between 25 and 34 are the most worried about their job, with 16% `expressing a concern`.

Since the third quarter of the year, the number of individuals `experiencing each sign of financial distress`, has increased – with a 60% rise in the number of people falling behind with some of their bills and payments.

Over one in four people admit to saving less than usual – 3% higher than in Q3 2010. More than three million people have taken on debt during the last quarter.

Steven Law, R3 President, said: “These figures make grim reading. The number of people who have admitted to struggling has rocketed over the last three months, but this is just the tip of the iceberg. There will be many more `below the waterline` who are struggling and have not yet admitted it.”

Madison County v. Oneida Indian Nation of New York

In Madison County v. Oneida Indian Nation of New York, Dkt. Nos. 05-6408, 06-5168 & 06-5515 (2d Cir. Apr. 27, 2010, cert. granted, __ U.S. __ (No. 10-72) (Oct. 12, 2010), the U.S. Supreme Court agreed to hear the appeal of Madison County and Oneida County from a decision of the Second Circuit Court of Appeals. The Second Circuit Court of Appeals held that the counties were barred by the principle of tribal sovereign immunity from proceeding with a foreclosure action against the Oneida Indian Nation for unpaid county taxes, though the taxes were properly assessed. One issue for the U.S. Supreme counties is whether there is a legal right to tax the property without any enforceable remedy.

It seems like the economy is affecting not only individual homeowners when it comes to foreclosures. For individuals, Chapter 13 bankruptcy is a solution for people who have trouble meeting their mortgage payments. Chapter 13 is not for everyone.
